P3 Guidelines

Summary of Guideline Changes

The Department wishes to thank everyone who provided comments to the draft P3 Guidelines. The Guidelines are designed to provide a general communication as to how the Department intends to implement the program. Particularly for Solicited Proposals, the specific details of how a procedure will be implemented will be contained within the Solicitation Documents.

Over 160 comments were received from interested public and private sector parties. For over 70% of the comments we incorporated the suggestions fully or partially, removed language or are retaining the suggestions for potential incorporation as more detailed procedures or documents are developed. Approximately 10% of the comments were general in nature and did not suggest specific language changes. Where the comments were not incorporated the vast majority related to the Reservation of Rights or similar sections, requests for fee caps and detailed timelines. The Department appreciates these concerns and while they wish to maintain sufficient flexibility to optimize the program, they also desire to approach this program as a true partnership between the public and private sectors.

These Guidelines will continue to be updated periodically so further comments are always welcome. A general summary of the major changes in the document from the prior version include the following:

  1. Many of the definitions were deleted unless necessary for understanding of the Guideline documents. Many of the terms originally included will be dealt with in specific procurement and contract documents.
  2. Clarification of the roles, membership of the Committees along with affirming confidentiality aspects.
  3. Further information related to Pre-Development Agreements.
  4. Clarify compliance with Federal "stipend" requirements as applicable.
  5. Emphasizing the Department's desire for Unsolicited Proposals to focus on providing creativity and innovation.
  6. Other clarifications on the Unsolicited Proposal process including providing information on how multiple Unsolicited Proposal Submissions for the same project will be addressed.
  7. Other changes dealt with improving the clarity and intent of previous language - many to address comments that were raised.
  8. Solicited Proposal section added.
