How to Request a Hearing
 

Hearing requests may be submitted by any one of these methods:

Your written request must include your: first, middle and last name; date of birth; license number; mailing address; home, cell and work phones; e-mail address, the Case Number on the notice you received from us and the reason for your request.

Upon receipt of your written request, a hearing may be scheduled and you will be notified by mail of the date, time and location.


General Information
 

If you request a hearing, the Department's Order, whether a suspension, assessment, business license cancellation or other action is usually 'stayed' pending the outcome of the hearing. In other words, the Department's Order will not go into effect until the hearing is held and the administrative law judge issues a final decision. As a general rule, this means that you can continue to drive, operate the business, avoid the accumulation of tax penalties, etc., pending the outcome of the hearing. This is a general rule however and does not automatically apply in every case. You should carefully read the Department Notice or Order to determine whether a stay applies in your case.

You must inform the Executive Hearing Office immediately if you change your address while your hearing is pending. If you fail to do so, you may lose your case by default.

If you require special accommodations, such as wheelchair access, sign language interpretation or TTY telephone accommodations, you must inform the Executive Hearing Office of that need at the time you file your hearing request.

Spend some time preparing for your hearing. Make a checklist of the major points that you want to make at the hearing. Know what you are trying to prove and stay focused. Do not waste time or confuse the judge with irrelevant issues. Speak clearly, simply and concisely. And above all, always be courteous to the judge, to the witnesses and to the opposing party.

Administrative hearings conducted by the Executive Hearing Office address a wide range of issues arising under the regulatory and enforcement powers of the Arizona Department of Transportation. These include driver license suspension/revocations, business licenses, tax issues, aircraft registration, motor carrier safety, highway advertising and much more. Tax Decisions
  Arizona law requires that tax decisions which involve 'substantive or significant' issues must be published for public access by the agency or department issuing that decision. A 'substantive or significant' tax decision, requiring publication, is one which:
  1. Answers a new question of Arizona tax law or constitutional law involving tax issues;
  2. Addresses a settled question of Arizona tax law, but involves a factual setting materially different than previously published decisions;
  3. Overrules or modifies previously published decisions involving Arizona tax law;
  4. Updates or clarifies established principles of Arizona tax law or which provides a different analysis of those legal principles.
