Endorsement and Exemption Definitions

(7) Commerce

49 CFR 383.5 means (1) any traffic within the jurisdiction of the United States between a place in a State and a place outside of such State, including a place outside of the U.S. and (2) trade, traffic and transportation described in paragraph (1) of this definition... Exemptions - 49 CFR 390.3 (f) (3)

 

(8) Farming

49 CFR 383.3 (d)(1) Farm vehicle controlled and operated by farmer, including operation by employees or family member. (2) used to transport either agricultural products, farm machinery, farm supplies, or both to or from a farm. (3) Not used in the operation of for-hire motor carrier, except for an exempt motor carrier as defined in 3990.5 of this subchapter, and (4) used within 150 miles from the farmer's farm.

 

(9) Hazardous

49 CFR 383.121, 390.5, 383.5. Meaning a substance, mixture or solution that has been determined by the United States Department of Transportation under 49 Code of Federal Regulations to be capable of posing an unreasonable risk to health, safety and property if transported in commerce, OR a substance that has been determined by the United States Department of Transportation under 49 code of Federal Regulations to be capable of posing an unreasonable risk to health, safety and property if transported in commerce... and ARS 28-3101.

 

(10) Active Military

(11) Private Motor Carrier

49 CFR 390.5. A person who provides transportation of property or passengers, by commercial motor vehicle and not a "For Hire" company.

 

(12) Emergency Response

49 CFR 383.3 (d)(2). Firefighters and other persons who operate commercial motor vehicles (49 CFR 390.5) which are necessary to the preservation of life or property or the execution of emergency governmental functions, are equipped with audible and visual signals and are not subject to normal traffic regulations.  These vehicles include fire trucks, hood and ladder trucks, foam or water transportation trucks, police SWAT team vehicles, ambulances, or other vehicles that are used in response to emergencies.

 

(13) Recreational Vehicle

49 CFR 383.5. However, ARS 28-3102 defines RV: a motor vehicle or vehicles combination that is more than twenty-six thousand pounds gross vehicle weight rating and that is designed and exclusively used for private pleasure, including vehicles commonly called motor homes, pickup trucks with campers, travel trailers, boat trailers and horse trailers used exclusively to transport personal possessions or persons for noncommercial purposes.

 

(14) Endorsement

49 CFR 383.5. Means an authorization to an individual's CLP or CDL required to permit the individual to operate certain types of commercial motor vehicles.
