When a vehicle owner passes away and their estate is valued at less than $200,000, you may be able to transfer the vehicle title to yourself without going through probate court.

Who Can Use Non-Probate?

You can use the Non-Probate Affidavit if you're claiming to be the successor of the decedent's property and all of these conditions are met:

  • The value of all the decedent's personal property, including vehicles, does not exceed $200,000
  • The estate is not under the jurisdiction of a probate court
  • At least 30 days have passed since the death of the deceased party
  • All owners listed on the title are deceased

What You'll Need

Gather these documents before you start:

  • Completed Non-Probate Affidavit (form 32-6901)
  • Current vehicle title, if available
    • Not required if the vehicle is currently titled in Arizona
    • Required for out-of-state vehicles
  • Lien release (if applicable)
  • Completed Title & Registration Application (form 96-0236)

What It Costs

You'll pay these fees when transferring the title:

  • Title processing fee: $4.00
  • Registration fees: vary based on Year, Make, Model, and Manufacturer’s Suggested Retail Price (MSRP)

You'll receive new plates, tabs, and registration. As the successor, you may be entitled to plate credit from the deceased owner's registration.

Multiple Owners on the Title

If there are multiple owners listed on the title and one owner is still living, the Non-Probate Affidavit may not be needed. The legal status between the owners (OR, AND/OR, or AND) determines how to proceed. Contact MVD for guidance on your specific situation.

Pursuant to A.R.S. § 14-3971 the following must be met:

- The vehicle's registered owner passed away more than 30 days ago.
- The value of the decedent's personal property does not exceed $200,000.
- You're the successor of the decedent, entitled to decedent's property by will or intestate succession.
- The estate is not under jurisdiction of a probate court

Yes, the out-of-state affidavit made by the successor is acceptable. If one is not provided, the following will need to be completed: 

A Non-Probate Affidavit, form 32-6901 along with a 96-0236 Title and Registration Application.

Visit an MVD Office to pay with debit card, credit card, cash or certified funds. You may also contact a Authorized Third Party Office, additional fees may apply.  

Arizona Resident: Yes, unless a Title Only Certification was completed.
For Out-of-State Resident: No.

No, you must wait the required 30 days. 

There is no penalty fee. However, the Title and Registration fees may apply and vary upon vehicle.

Yes, you can visit any MVD Office or also go to an Authorized Third Party location, additional fees may apply.

A lien release or letter of permission from the lienholder is required.

You will need to transfer the vehicle into your name before selling the vehicle.
